Illinois Gov. Pritzker signs two PFAS bills into law
Illinois Gov. JB Pritzker signed two bills into law Aug. 15 related to the phase-out of PFAS in a variety of products. These included the PFAS Reduction Act (HB 2516) and the Deputy Chief Pete Bendinelli PFAS PPE Act (HB 2409).
The PFAS Reduction Act bans the sale, manufacture and distribution of intentionally added PFAS in cosmetics, dental floss, juvenile products, menstrual products and intimate apparel in the state beginning Jan. 1, 2032. Previously, the ban was set to begin Jan. 1, 2026, and applied to cookware, cosmetics, dental floss, juvenile products, menstrual products, intimate apparel and food packaging or food contact products.
The Deputy Chief Pete Bendinelli PFAS PPE Act bans the manufacture, sale and distribution of firefighting personal protective equipment (PPE) containing intentionally added PFAS in the state beginning Jan. 1, 2027. Beginning Jan. 1, 2026, those who manufacture, sell or distribute firefighting PPE in the state must provide written notice to the purchaser at the time of sale that states “(i) that the firefighting personal protective equipment contains PFAS chemicals; and (ii) the reason PFAS chemicals are added to the equipment.” Both the seller and purchaser must keep a copy of the required notice for at least 3 years from the purchase date.
The act also adds a definition of “auxiliary firefighting personal protective equipment” and bans the manufacture, sale or distribution of auxiliary firefighting personal protective equipment containing intentionally added PFAS beginning Jan. 1, 2030.
